Terms of Service

These terms govern your use of SKN Pay, a payment platform operated by CenPOS. By creating a merchant account or paying via a SKN Pay payment page, you agree to these terms.

1. The Service

SKN Pay provides Caribbean merchants with tools to accept card payments, issue invoices, manage customers, and process refunds. Card processing is provided by NMI; SKN Pay is the merchant-of-record platform layered above it.

2. Eligibility

Merchant accounts are available to legitimate businesses operating in the regions we serve. We may verify business legitimacy at signup and at any time after. We may decline or terminate accounts in regulated, prohibited, or high-risk categories (including but not limited to: adult services, illegal goods, unlicensed financial services, gambling without a licence, pyramid schemes).

The transaction is between the merchant and the customer. SKN Pay facilitates the payment but is not party to the underlying contract for goods or services. Merchants are responsible for their own customer service, refund decisions (within card-network rules), and dispute resolution.

6. Fees

Processing fees, platform fees, and any other charges are set out in the separate merchant agreement signed at onboarding. Fees may be revised on notice as outlined in that agreement.

7. Refunds and chargebacks

Merchants may issue refunds through the dashboard. Refunds settle subject to NMI and card-network rules. Chargebacks initiated by cardholders through their issuing bank are governed by the card networks; SKN Pay will pass through the relevant evidence and outcomes from NMI.

8. Customer-initiated reports

Customers may use the “Report a problem” channel on the customer wallet to raise concerns about a payment. These reports are emailed directly to the merchant; SKN Pay receives a copy for audit and may step in if a pattern of unresolved issues emerges.

9. Suspension and termination

We may suspend or terminate accounts that breach these terms, that present unacceptable fraud or chargeback risk, or that fail KYC/KYB verification. Merchants may close their account at any time; transactional records will be retained for the period required by law and the merchant agreement.

10. Disclaimers

The platform is provided “as is.” We make no warranties beyond those required by applicable law. We do not guarantee uninterrupted operation, though we work to minimise downtime and respond to incidents promptly.

11. Limitation of liability

To the maximum extent permitted by law, SKN Pay’s aggregate liability arising from or related to these terms or the platform will not exceed the platform fees paid to SKN Pay by the merchant in the three months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

13. Governing law

These terms are governed by the laws of the Federation of Saint Kitts and Nevis. Disputes will be resolved in the courts of that jurisdiction unless we agree otherwise.

14. Changes

We may update these terms from time to time. Material changes will be announced via the merchant dashboard or by email. Continued use of the platform after notice constitutes acceptance.
